Terms of Service — EazyWon

§ 1 Scope
These Terms of Service (ToS) apply to the use of the platform "EazyWon", operated by:

A usage contract is concluded upon registration. Acceptance of these Terms of Service is required.
The platform is aimed exclusively at consumers (B2C) within the meaning of § 13 of the German Civil Code (BGB), i.e. natural persons aged 18 or older who use EazyWon for private, non-commercial purposes. Business or commercial use is not permitted.
§ 2 Subject Matter / Service Description
EazyWon is a free, purely entertainment-oriented online platform for predicting sporting events. Users can engage in battles against each other and collect virtual Battle Points.
The platform serves exclusively entertainment purposes. No deposits or withdrawals are made. No economic claim exists.
Battle Points:
- have no monetary or material value
- are not transferable
- are not tradeable
- do not constitute any claim to services
To provide the platform, statistical evaluation of user data is performed to create rankings and game mechanics (profiling within the meaning of the GDPR).
Pure entertainment: EazyWon serves exclusively for entertainment and does not offer any legal, financial, betting or other professional advice or service. All content, predictions, statistics and tip evaluations are purely for entertainment and do not constitute a recommendation. The operator makes no guarantees or assurances beyond the pure entertainment value. Liability for damages arising from content being misunderstood as professional advice is excluded.
§ 2a Financing & Advertising
The platform is free for users and may be financed through advertising. Third-party advertisements (e.g. rewarded video ads) may be displayed. Users may receive additional Battle Points for viewing certain advertising content. These points still have no monetary or material value and constitute no economic claim. Where advertising service providers process personal data, this only happens after prior consent; details are governed by the Privacy Policy.
§ 2b Invitation / Referral Programme
Users can invite other people to register via a personal invitation link. For successful referrals (e.g. when invited persons register and complete a minimum number of battles), bonus Battle Points may be credited. These points are likewise virtual, non-transferable, non-tradeable and without monetary or material value. A claim to the bonus exists only upon fulfilment of the conditions specified in the registration/invitation process or in the "How it works" guide on the platform (currently: successful registration of the invited person via the personal link and completing at least five battles); the operator may change or discontinue the programme at any time.
§ 3 Registration & Minimum Age
- Registration takes place via the platform by providing first name, last name, nickname, email address, date of birth, country and favorite sport, as well as a password. Providing a favorite team is optional. First and last name must be your real, truthful legal name; pseudonyms, placeholders or evidently false names are not permitted (the publicly visible nickname is exempt from this).
- Activation for use only occurs after confirming the email address via a confirmation link sent by email (double opt-in).
- Use is permitted only to persons aged 18 or older; the offering is labelled accordingly for youth-protection software (technical age labelling pursuant to § 5 JMStV).
- By registering, the user confirms the accuracy of their information.
- The operator may take appropriate plausibility-checking measures.
- Only one account is permitted per person.
§ 4 User Behavior / Content
Users commit to lawful and fair behavior. The following are prohibited in particular:
- Insults, discrimination, hate speech
- Spam or automated use (bots, scraping, scripts)
- Multiple accounts or identity concealment
- Unlawful content
- Introducing viruses, trojans, worms or other malicious code
- Hacking, manipulating or circumventing security features of the platform
- Renting, selling, sublicensing or otherwise transferring the account to third parties
- Any commercial use of the platform without the operator's express permission
Chat functions may be stored and processed for moderation and platform improvement. The operator is entitled to remove content and block users.
Consequences of violations: In case of violations of the above rules (in particular insults, discrimination, hate speech, threats, harassment or unlawful content), the operator is entitled to take appropriate measures depending on severity and repetition, including:
- Removing or hiding the content concerned
- Warning the user
- Temporarily suspending features (e.g. chat) or the account
- Permanent suspension and deletion of the account for serious or repeated violations
- For criminally relevant content (e.g. incitement, threats): forwarding to the competent authorities
Users can report and block content and other users via the report and block functions provided in the platform. Reported content is reviewed; unlawful content or content violating these terms is removed (notice-and-action procedure under the Digital Services Act).
§ 5 Usage Rights to Content
The user grants the operator, for the duration of the usage contract, a simple, geographically unlimited right to store, host, reproduce, technically edit, display and make accessible to other users to the necessary extent the content they provide (e.g. nickname, avatar, chat/trash-talk contributions, tips) — e.g. displaying the nickname/avatar in battles and rankings. No use beyond this takes place.
The user warrants that they hold all necessary rights to the content they upload and that providing it does not infringe any third-party rights.
§ 6 Platform Availability
There is no claim to permanent or uninterrupted availability of the platform. The operator is entitled to change, interrupt, or discontinue operation temporarily or permanently.
§ 7 Liability
The operator is liable without limitation for intent and gross negligence as well as for injury to life, body, or health.
In the case of slight negligent breach of material contractual obligations, liability is limited to the foreseeable damage typical for this type of contract.
Liability for:
- Game outcomes
- Rankings
- Data loss outside the sphere of influence
- Technical availability
is excluded to the extent legally permissible.
§ 8 Data Protection
The processing of personal data takes place in accordance with the separate Privacy Policy.
§ 9 Termination & Deletion
The usage contract may be terminated by either party at any time without giving reasons. The user can request deletion of their account at any time via the platform.
After the deletion request, a 30-day revocation period begins, during which the user can reverse the deletion and the account is locked. After these 30 days, the account is permanently and completely deleted — including all associated personal data, profile details, tips, battles and chat contributions. Excluded is only data that the operator must retain due to statutory retention obligations or to assert, exercise or defend legal claims.
The operator may block or delete accounts in case of violations of these Terms. Upon the termination taking effect, the usage relationship ends and the access can no longer be used.
§ 10 Changes to the Terms of Service
The operator reserves the right to change these Terms, to the extent reasonable. Changes will be communicated to the user at least six weeks before they take effect, by email or via a notice within the platform.
If the user does not object to the changes within six weeks of receiving the notice, the changes are deemed accepted; this will be pointed out separately in the notice. If the user objects in time, both parties have a special right of termination; in that case the Terms continue in their previous version until the contract ends.
§ 11 Technical Service Providers
External technical service providers are used to provide the platform (e.g., hosting, databases, CDN, email delivery). Details see Privacy Policy.
§ 12 Operator Obligations
- The services offered are subject to continuous further development and may change from time to time to a reasonable extent. The operator may temporarily or permanently discontinue individual functions or the entire services and will communicate material changes with appropriate notice.
- The operator endeavours to keep the platform up to date and available, but does not owe any specific availability and assumes no liability for data loss due to technical disruptions or the discontinuation of services.
§ 13 Copyright
- The operator holds the copyright to all content published by it on the platform (images, texts, graphics, logos). Use without express consent is not permitted.
- Rights to content uploaded by the user remain with the user; they merely grant the operator the usage rights set out in § 5.
§ 14 Applicable Law / Jurisdiction
- German law applies.
- Place of jurisdiction is Oldenburg, to the extent legally permissible. Otherwise, the statutory provisions on the choice of jurisdiction apply.
The operator does not participate in dispute resolution proceedings before a consumer arbitration board within the meaning of the German Consumer Dispute Resolution Act and is not obliged to do so.
